The families of the three victims killed in the Greenwood Park Mall shooting in 2022 have initiated a wrongful death and negligence lawsuit against Simon Property Group, the mall’s owner.
On July 17, 2022, a tragic shooting unfolded at Greenwood Park Mall around 6 p.m. Jonathan Sapirman, 20, began shooting after emerging from a restroom in the food court. Elisjsha Dicken, 22, from Seymour, who was armed, responded to the threat and managed to fatally shoot Sapirman, stopping the attack.
The victims, Pedro Pineda, 56, Rosa Mirian Rivera de Pineda, 37, and Victor Gomez, 30, were killed, with two others injured during the incident.
The lawsuit, filed on Tuesday, accuses Simon Property Group and Allied Universal Security Services of failing to prevent the shooting. It alleges that Simon Property Group was aware of previous criminal incidents at their malls but did not allocate adequate resources to monitor and address suspicious activities or potential weapons.
The legal action points out that in the past three years, there have been at least four shootings at Simon malls in and around Indianapolis. The lawsuit claims these incidents highlight a severe and foreseeable risk in public spaces like shopping centers.
Additionally, the lawsuit criticizes the mall’s security response, noting that there were no security personnel present in the food court during the attack. It argues that if the armed bystander had not intervened quickly, the situation could have resulted in even more casualties.
Attempts to reach Simon Property Group for comment have been unsuccessful.
