In a tragic incident at Brooklyn’s Flatbush Gardens, a security guard reportedly watched a fatal shooting in real-time without intervening or contacting emergency services. The guard is accused of subsequently uploading the disturbing footage to the internet, leading to a $10 million lawsuit filed by the victims’ family.

Allegations of Negligence and Misconduct

The lawsuit, initiated by Marie Delille, centers on the deaths of her husband, Bladimy Mathurin, 47, and her son, Chinwai Mode, 27. They were fatally shot by neighbor Jason Pass on October 29, 2023, following a history of reported harassment. Delille contends that the building’s management and security personnel were aware of Pass’s erratic behavior but failed to take appropriate action.

According to the suit, the security guard monitored the fatal shooting via surveillance cameras but did not alert authorities. Shockingly, the footage was allegedly posted online before law enforcement arrived at the scene. Delille discovered the video circulating on platforms like Worldstar and Facebook, exacerbating her family’s trauma.

Legal Action Against Property Owners

The lawsuit names Renaissance Equity Holdings and Clipper Realty, the owners of Flatbush Gardens, accusing them of negligence, wrongful death, and infliction of emotional distress. Delille asserts that despite multiple complaints about Pass’s threatening behavior and the lack of adequate security, the management failed to address the issues, ultimately leading to the tragic event.

The suit highlights a broader history of violence at the 59-building complex, citing previous incidents and arrests that underscore ongoing safety concerns. Delille’s attorney emphasizes that the property owners’ negligence contributed to creating a dangerous environment, allowing such horrific events to occur.

Ongoing Trauma and Pursuit of Justice

In the aftermath, Delille and her surviving children continue to grapple with profound grief and trauma. Despite these challenges, Delille is persevering in her nursing studies, aiming to graduate soon. She remains determined to seek justice for her husband and son, holding those responsible accountable for their alleged negligence and misconduct.
