The mother of a security guard killed at a Deep Ellum nightclub last month has filed a wrongful death lawsuit seeking over $1 million in damages, accusing the venue of prioritizing profits over safety.

Shamieh Law filed a lawsuit on behalf of Juliana Gray and the estate of her son, Joseph Gray, in a Dallas County district court on June 2. The suit names MRVS Taxco, LLC, doing business as La Tardeada, and Detorius Tarver as defendants.

According to Dallas police, the shooting occurred on May 5, 2026, inside La Tardeada located at 2810 Elm St. Police said the preliminary investigation showed that Tarver, 23, was involved in a physical disturbance inside the business. Joseph Gray, 26, was working as a security guard and trying to break up the fight when Tarver shot him, according to authorities. A co-worker transported Gray to a local hospital, where he later died from his injuries. Tarver was arrested and charged with murder.

The lawsuit alleges that La Tardeada operated as a “haven for bad actors” with unwritten policies designed to attract dangerous people. The petition claims management allowed individuals to pay a premium fee to circumvent security, permitting them to bring drugs and weapons inside.

According to the filing, Tarver allegedly bypassed security with a gun in exchange for a fee. The lawsuit states that “as Gray was doing his job, Tarver reportedly pulled out his gun and executed Gray with a point-blank shot.”

The plaintiff accuses the club of gross negligence, premises liability, and failing to provide safe working conditions or call 911 until after the shooting. The suit also references statements from Dallas City Council member Jesse Moreno, who noted he was “not surprised” by the incident, describing the venue as a constant problem since opening less than a year ago.

Following the shooting, La Tardeada announced a temporary closure. In a Facebook statement, the restaurant said it is fully cooperating with law enforcement, adding, “Our focus remains on supporting the victim’s loved ones, assisting law enforcement, and ensuring the safety and well-being of our staff and patrons.”

Alberto Herrera, general counsel for La Tardeada, issued a statement addressing the legal filing. “Our hearts go out to the family of the deceased and everyone impacted by this tragedy,” Herrera said. “In accordance with our policy, we do not comment on pending litigation.”
