SACRAMENTO, Calif. — Leading California Democrats, including Governor Gavin Newsom, have announced a new ballot measure targeting retail theft, aiming for a vote in November. This proposal offers an alternative to a more stringent initiative supported by retailers and law enforcement.
The Democratic plan seeks to reduce incarceration rates compared to the other proposal. Both measures would elevate shoplifting to a felony for repeat offenders and impose stricter penalties for fentanyl-related offenses. However, the Democrats’ approach is more limited in scope.
The retailers’ initiative suggests that any previous theft-related conviction, regardless of its age, could trigger a three-strike policy leading to harsher sentences. In contrast, the lawmakers’ proposal stipulates that convictions must occur within three years of each other for enhanced penalties to apply. Additionally, the Democratic plan allows prosecutors to combine the value of stolen goods over three years to charge more severe offenses.
